The purpose of this document is to outline the rationale for executing a modification and extending sole source task order 140D0422F0019 for software development, maintenance, and support services for up to an additional six (6) months of performance while the Government awaits a decision from the United States (US) Court of Federal Claims (CoFC) on a protest filed against the follow-on competitive award. The follow-on task order (140D0421F0660) was awarded on August 30, 2021, but a performance stay has been in place since then as a result of the protests received, first with the Government Accountability Office (GAO) and now with the US CoFC, making it impossible to begin the transition to the new contractor.

To preclude a lapse in service, AQD initially issued a Firm Fixed Price (FFP) sole source task order to the incumbent contractor, Digital Management, LLC (DMI), on October 25, 2021, but it is set to expire on October 30, 2022. Since the Government has already exercised the extension of Federal Acquisition Regulation (FAR) Clause 52.217-8, “Option to Extend Services,” a new LSJ is required in order to extend the sole source task order for up to an additional six (6) months to ensure HHS-OIG continues to receive the necessary support…
