Protest forces VA to Modify Task Order for Health Product Support

“Description of Action: The proposed sole source action is for a Firm-Fixed-Price modification for a one-month extension to task order VA11816F10150013 issued under Transformation Twenty-One Total Technology Next Generation (T4NG) Contract VA118-16-D-1015 for Health Product Support (HPS) Tier 3 (T3) Sustainment Support for Clinical Applications with Liberty IT Solutions, LLC (Liberty), 2303 Dulles Station Boulevard, Suite 210, Herndon, Virginia, 20171.”

“Description of the Supplies or Services: The scope of the HPS T3 task order is to provide product sustainment support to HPS Clinical Applications to ensure that sustainment products are available for clinical use and maintain support for the Veterans Health Administration (VHA) customer base. This task order was initially awarded with a 12-month Base Period beginning on January 10, 2017, with four 12-month Option Periods and 12 Optional Tasks. On January 7, 2022, the last Option Period was previously extended through March 9, 2022. On September 29, 2021, a new T4NG task order, VA118-16-D-1015 36C10B21N10150057, Health Services DevSecOps (H-DSO) Support, was awarded for the Office of Information and Technology (OIT) by the Technology Acquisition Center (TAC) using competitive procedures for shippable products, operations support, and security compliance in support of the VA OIT with a performance start date of October 1, 2021. This new HDSO task order was awarded to Liberty and addresses multiple IT services for the entire VA OIT Health Portfolio, and through the exercise of Optional Tasks, will also encompass services previously provided by the HPS T3 Sustainment Support task order.”

“However, on October 12, 2021, two (2) unsuccessful offerors filed Government Accountability Office (GAO) protests challenging the H-DSO award, causing delays to transitioning support efforts. A decision denying the protests was rendered by GAO on January 20, 2022, which allowed VA and Liberty, as the H-DSO contractor, to resume activities. The stay of contract performance was lifted January 24, 2022 and extensive intake activities began. Under the H-DSO task order structure and provisions an intake process is required due to the complexity and criticality of the applications…”

“In order to ensure a seamless transition of this critical product sustainment support, it is imperative that the HPS T3 Sustainment Support task order VA11816F10150013 be extended for an additional one-month to continue operations. Without this extension, VA faces a gap in service as the current task order expires on March 9, 2022 and the transition support is not expected to be completed until April 9, 2022. Any break in service for the tasks under the HPS T3 task order would be catastrophic to Veterans and the operations of VHA…”
