The proposed action is for a firm-fixed-price task order under the NASA, SEWP, Government-wide Acquisition Contract (GWAC) with FedStore Inc. to procure Pegasystems consulting services in order to perform the required COTS tailoring and custom development services needed to complete a POC, encompassing a prototype demonstration of the Pegasystems CRM application in a simulated operational environment supplied by CMS.

CMS will procure the commercial-off-the-shelf (COTS) solution tailoring and custom development services needed to complete a POC, encompassing a prototype demonstration of the Pegasystems CRM application in a simulated operational environment to be supplied by CMS. The services to be acquired are peculiar to Pega, the manufacturer of the CRM solution selected at the conclusion of the aforementioned Analysis of Alternatives, based on the “authority and rationale” discussed below in Section 3. The period of performance for these services will be one (1) year. The contractor shall supply all relevant Pegasystems CRM licensing required to perform the work associated with this contract for the duration of this contract. The CMS APP number for this action is 192138.

CMS plans to acquire these services without a competitive process based on the justification that Fedstore Inc. is the sole Pegasystems reseller under the NASA SEWP V contract that can fulfill the Agency’s requirements. Only Pega possesses the proprietary rights to the perpetual license, software updates, customer support, and technical updates, and/or capability to:

  • Modify the proprietary source code of the Pegasystems CRM application to resolve software bugs, develop enhancementsnew features, and satisfy all CMS requirements while ensuring future compatibility
  • Control the overall functionality, performance, and evolution of the Pegasystems CRM application
  • Ensure design integrity, stability, and interoperability of the Pegasystems CRM application with Government legacy and/or modernized systems
  • Perform white-box software testing in which the internal structure, design, and implementation of the Pegasystems CRM is visible to the tester
  • Provision a team possessing: (a) unique and highly specialized Pegasystems CRM knowledge and skills; (b) experience successfully implementing large-scale Pegasystems CRM solutions for other Federal agencies such as the Census Bureau and IRS; and, (c) autonomous access to the Pega’s proprietary internal resources (i.e., product development team, product support team, product deployment team, process assets, knowledgebase, source code, etc.)
